Retirement in the spotlight
We now know that the default retirement age is to be abolished and retirement will cease to be a fair reason for termination. So is this the end of compulsory retirement? Not according to the Government's consultation paper which tells us "It will still be possible for individual employers to operate a compulsory retirement age, provided that they can objectively justify it." We look at what this will mean in practice for employers.
What is certain is that the current default retirement age of 65 is to be abolished and it is worth planning ahead. You can still compulsorily retire an employee with minimal risk if you follow the current advance notification process (including at least 6 months notice and telling them about their right to request to continue working), as long as the retirement date occurs prior to 1 October 2011 and they have been notified prior to 1 April 2011.
