Key Decisions on Age Discrimination

The Supreme Court has handed down its decision on two important age discrimination claims. Head of Steeles Law’s employment team, Oliver Brabbins, considers the implications of these judgments.

The conjoined cases were those of Seldon v Clarkson Wright and Jakes, concerning the compulsory retirement of a partner at the age of 65 and whether this amounted to direct age discrimination (see our previous briefing), and Homer v Chief Constable of West Yorkshire in which it was claimed that the requirement to hold a degree in order to be considered for promotion was indirectly discriminatory on the grounds of age (see our previous briefing).
